These Terms and Conditions (T&Cs) govern the relationship between BETA COMPUTERS LIMITED (BCL) and customers of BETAWORKSPACES (BWS) on www.betaworkspaces.com website. Customers are advised to carefully read the below T&Cs before placing any orders on our website as placing any order or creating an account means that you have consented to and bound by these T&Cs.
1.0 Definitions
1.1 Platform: Our www.betaworkspaces.com website, our mobile applications or any other electronic medium we may use to offer our products and or services to the public
1.2 Electronic Commerce: Covers the sending, transmission, reception, storage of data messages electronically.
1.3 Customers: Individuals registered on or through our website
1.4 Personal data: All information that allow or make identifiable an individual.
1.5 Product: All and any products or spaces or services displayed through the website.
1.6 Advertising: Any form of communication carried out by BWS with the purpose of providing information on products, commercial activities and communicating advertising or marketing strategies or campaigns, either for itself or for third parties.
2.0 Platform Offering
- Through the Platform, BWS display products for purchase by customers.
- BWS will not and does not store any customers debit and credit card details as such are entered directly into PAYSTACKS secured online payment gateway on the website.
- BWS may cancel orders made for products and services at its own discretion and with reasonable notice to the customer
- Where orders are cancelled by BWS, customer is entitled to a full refund of payments made for the order.
- BWS reserves the right to update, modify and / or discontinue any of and or the products displayed on the website at any time, without any prior notice.
- BWS warrants that although the website is available 24 hours a day for transactions, it does guarantee its permanent continuity.
- BWS reserves the right to, without any prior notice or explanation, cancel user accounts and / or to prohibit access to the website or our offices for customers whose conduct violate these T&Cs or causes any direct or indirect damage to BWS, its customers or other stakeholders.
3.0 Customer Ordering
By creating an account and or placing an order through the BWS website, customer expressly and unequivocally:
- Agree to the T&Cs of the Platform
- Enters into an agreement with BWS to process their orders.
- Accepts that BWS is responsible for Orders delivery and any refunds.
- Accepts responsibility for the accuracy and completeness of all information provided by them on the website.
- Warrants not to use the website to perform any acts contrary to morals, the law, public order and good custom.
- Warrants not to be involved directly or indirectly in any conduct that undermines the functioning of the website
- Accepts that BWS may use Cookies on all activities carried out on the website
- Accepts that they can only be entitled to any refund if an order is cancelled earlier than 72 hours to the order delivery hour
- Accepts that the refund for a canceled order will be made within 48hours of the cancellation and subject to a deduction of a processing fee of 30%
- Accepts that data and information BWS collected expressly, consciously and voluntarily can be used by BWS in any way and manner in furtherance of their advertising and legitimate business, communication and strategies in accordance with Nigeria laws.
4.0 Governing Law and Dispute Resolution
- These Terms and Conditions shall be governed by and construed in all respects in accordance with the laws of the Federal Republic of Nigeria.
- In the event of any dispute, or disagreement between the parties in relation to this T&Cs, the Parties shall at first, meet to resolve such disputes through discussions amicably. In the event the Parties fail to resolve any matter within a period of thirty (30) days, either party may refer the dispute to a sole Arbitrator to be appointed by the parties herein, or in the absence of such agreement, to an Arbitrator appointed by the High Court of Lagos State.
- The provisions of the Arbitration and Conciliation Act (Cap A18) Laws of the Federation of Nigeria 2004 shall apply to the arbitral proceedings. The venue of the arbitration shall be Lagos city and the decision of an Arbitrator appointed under this clause shall be final and binding except where there is a manifest error in law or fact or miscarriage of justice.
5.0 Limitation of Responsibilities
All products and services made available on the website are provided “as is” and “as available” without warranty of any kind, express or implied, including, but not limited to, implied warranties of fitness for a specific purpose.
